Mom convicted of three-way sex with her 14-year-old daughter and another man
A man went on trial yesterday on charges related to simultaneous sexual relationships with a Kitchener woman and her teenage daughter.
Robert Miller, 30, of Grand Bend pleaded not guilty in Superior Court to sexual assault, invitation to sexual touching, accessing child pornography and sexual exploitation.
The allegations cover a period between the fall of 2002 and the summer of 2003 after Miller met the woman on the Internet and began chatting online with her 13-year-old daughter as well.
“It started as small talk and got into sexual things,” said the girl, now 17.
Their contact in Internet chat rooms, she said, included sending pornographic photographs of herself to Miller, who was married with a daughter of his own.
The girl testified she had sex with Miller both before and after she turned 14, the legal age of consent. Included were fondling, oral sex and intercourse after she initially rejected his advances.
“He kept on trying, so I just gave in to it and let him,” she said.
A court order prohibits publication of information that could identify the girl.
The worst incident, soon after her 14th birthday, allegedly involved graphic three-way sex between the girl, her mother and Miller.
The mother pleaded guilty in the summer of 2005 to sexual exploitation in connection with that incident.
She was sentenced to six months of house arrest and 18 months on probation, getting credit from the judge for taking counselling for mental health problems.
Her lawyer said the mother was having marital difficulties when she met Miller on the Internet and “thought she was on top of the world” because of the attention he gave her. Court heard the woman left her marriage and sold all of her assets to give Miller money for his interests in race cars and boats.
Miller wasn’t charged until well after the woman pleaded guilty in 2005 and the girl’s father pushed to have the case pursued further.
Defence lawyer Dave Reid cross-examined the daughter on differences in statements she gave authorities at various times since police first got involved.
He suggested her mother was angry because Miller wasn’t initially charged and that the girl is now tailoring her evidence — adding details about sex before she turned 14, for instance — to help her get back at him.
The trial is scheduled to continue today.
